Could someone please for the love of all that is not-so-silent and not-so-holy, for the next two weeks, just not have a court case conclude right before we go on our break. Technically this court case isn’t actually over, there will be a series of settlement finalization put in place (probably), but for the most part, it is over. What case am I talking about? Common sense vs CD Projekt for the shambolic release of Cyberpunk 2077. From broken AI right down to broken sanity for releasing that game on PS4, there was a myriad of issues upon its initial release last December.
Yesterday, (Thank you, PC Gamer) the company announced a $1.85 Million settlement, which was reached following a halt to court proceedings to define what the settlement would be before a judge could, most likely in CD Projekt’s eyes, do more damage to the company’s bank account. In their statement, filled with all the usual legal nonsense, you’ll find that the negotiations on a settlement began on the 7th and took a further 8 days to wrap up. Parsing the statement where possible, with the agreement now in place those bringing the case against CD Projekt will “relinquish all claims against the Company and members of its Management Board.”
Furthermore, CD Projekt agreed to the “execution of the Term Sheet does not imply admission of any responsibility on the part of the Company or any of the other defendants named in the case.” This in itself is a bit of a slap in the face of anyone who was sold a faulty product by not only CD Projekt but also the hype machine surrounding it, which the company helped ferment.
It is typical of US court cases to go this way, as the statement says, “the general practice in the U.S. of concluding such litigation by way of an out-of-court settlement.” However, for a relatively paltry sum of the company’s profits for selling such a faulty product (I’m not blaming developers, I’m blaming management) does seem like another “up yours, got mine” to those who bought it.
